1. General Provisions
These Terms of Use (the “Terms”) govern the use of the OfferHack information and analytics AI service (the “Service”), available at offerhack.tech, as well as through the client application.
The Terms are an integral part of the Public Offer Agreement and apply together with the Personal Data Processing Policy and the Refund Policy. In the event of any conflict between the Terms and the Public Offer Agreement, the Public Offer Agreement prevails.
By using the Service, the User confirms that they have read and agree to these Terms. If the User does not agree with any provisions of the Terms, they must stop using the Service.
The Terms are drawn up in Russian. If a translation into other languages is posted, the Russian version prevails.
2. Description of the Service
OfferHack is an information and analytics software product that uses artificial intelligence technologies to help Users prepare for interviews, practice answering questions, and analyze study materials.
The functional capabilities of the Service may include (the full list is determined by the selected pricing plan):
- generation of AI responses to the User’s text queries;
- recognition and analysis of voice queries;
- analysis of images (screenshots) of tasks and questions;
- provision of educational and informational materials;
- other features described on the Website.
The Service is provided in its current functional state. The list of features, their composition, and the procedure for their provision may be changed by the Provider in the manner provided for in the Public Offer Agreement.
3. Registration and Account
To use the paid features of the Service, the User registers by providing an email address and creating a password. Upon registration, the User:
- provides accurate information and keeps it up to date;
- confirms that they have reached 18 (eighteen) years of age;
- checks the box accepting the Public Offer Agreement, these Terms, and the Personal Data Processing Policy;
- gives separate Consent to the processing of personal data.
The User bears full responsibility for the security of their account credentials. It is prohibited to transfer the login and password to third parties, to use other persons’ credentials, or to create multiple accounts to circumvent pricing-plan restrictions or promotional offers.
The User must immediately notify the Provider of any unauthorized use of the account at admin@offerhack.tech.
4. Rules for Using the Service
When using the Service, the User undertakes to:
- comply with these Terms, the Public Offer Agreement, the Personal Data Processing Policy, and applicable law;
- use the Service in good faith, solely for personal, educational, or other lawful purposes;
- respect the rights and interests of other users and refrain from sending offensive, unlawful, or otherwise unacceptable queries;
- independently verify information obtained through AI responses before using it in material decisions;
- pay for the services in the manner and amount established by the selected pricing plan;
- not use the Service during interviews, exams, tests, certifications, technical interviews and other assessment procedures, if the rules of the relevant procedure, the policy of the organizer, employer, educational organization, proctoring platform or an applicable non-disclosure agreement (NDA) expressly or implicitly prohibit the use of external sources, AI services, hint tools or other aids; independently verify the permissibility of using the Service in each specific situation;
- not submit to the Service information constituting commercial, professional, banking, state or other secrets protected by law of third parties, as well as information transferred to the User under a non-disclosure obligation, without the necessary legal grounds.
5. Prohibited Actions
The User is prohibited from:
- using the Service to commit unlawful acts, fraud, or infringement of the rights of third parties;
- using automated tools (scripts, scrapers, bots, crawlers, emulators) to access the Service without the written consent of the Provider;
- decompiling, disassembling, or reverse engineering the software of the Service;
- using the Service, AI responses, transcripts and other results of the Service to create competing products, to train, fine-tune or otherwise improve their own or third-party AI models, or to resell access to third parties;
- circumventing or attempting to circumvent the technical limitations of the pricing plan (rate limits, usage limits, request frequency limits, parallel request limits);
- creating multiple accounts to circumvent pricing-plan restrictions, obtain repeated trial periods, promotional offers, credits or other restrictions;
- transferring the account to third parties, selling, leasing, sharing access to the account, or using a single account jointly with other persons;
- initiating unjustified payment dispute (chargeback) procedures or otherwise abusing payment card holder rights in the absence of lawful grounds for a refund;
- deliberately overloading the Service’s infrastructure (DDoS attacks, excessive requests);
- attempting to gain unauthorized access to other users’ accounts, to servers, or to other components of the Service;
- transmitting through the Service malicious code, viruses, or other components capable of disrupting the operation of the Service or other information systems;
- uploading or transmitting through the Service materials containing scenes of sexual exploitation of minors, calls to violence, terrorism, extremism, hate speech, or other materials violating applicable law;
- passing off AI responses as their own texts in contexts where this is prohibited (academic environments, employer assessment procedures, professional certification, etc.) — the User bears sole responsibility for such actions.
6. Specifics of the AI Service
6.1. Advisory nature of AI responses
The Service is an information and analytics AI tool. The AI responses generated by the Service are informational, educational, and advisory in nature. They are NOT:
- professional advice (legal, medical, financial, tax, HR-related, or psychological);
- an educational service;
- guaranteed accurate information about facts, events, persons, or organizations;
- the official position of employers mentioned in AI responses.
6.2. Possible AI errors
AI systems may generate inaccurate, incomplete, outdated, or fabricated information (“hallucinations”). The User undertakes to independently verify important information.
6.3. No guarantee of results
The Provider does NOT guarantee that the User will receive a job offer from an employer, an invitation to an interview, employment, a raise, career advancement, or any other career outcome. The Service is an auxiliary preparation tool; the final outcome depends on many factors beyond the Provider’s control.
Any decisions made by the User on the basis of AI responses are the User’s own decisions. The Provider is not responsible for such decisions or their consequences.
6.4. Use of third-party AI
To generate AI responses, the Service uses the application programming interfaces (APIs) of third-party AI model developers — OpenAI L.L.C., Anthropic PBC, and other providers. Changes in the operation or availability of these APIs may affect the composition and quality of the Service’s features.
Detailed specifics of the AI service are set out in Section 10 of the Public Offer Agreement.
7. Intellectual Property
All rights to the Service, including the program code, design, interface, trademarks, brand identifiers, texts, graphic images, and other materials, belong to the Provider or its licensors and are protected by the intellectual property laws of the Russian Federation.
The User is granted a limited, non-exclusive, non-transferable right to use the functional capabilities of the Service for the term of the Public Offer Agreement for personal, educational, career-related and other lawful purposes, subject to compliance with these Terms, the Public Offer Agreement, the rights of third parties, applicable law and the terms of Third-Party Services.
It is prohibited to copy, modify, distribute, sell, lease, or sublicense any components of the Service without the written consent of the Provider.
The use of the Provider’s trademarks and brand names is permitted only with the Provider’s prior written consent.
8. User Content
The User retains the rights to the content that they independently create and/or upload to the Service (query texts, files, images).
By uploading content to the Service, the User grants the Provider a non-exclusive, worldwide, royalty-free right to use such content solely for the purposes of providing the services (processing queries, generating AI responses, storing it in the Account, and ensuring security).
The User warrants that they:
- hold all necessary rights to the uploaded content;
- do not upload content that infringes the rights of third parties, an employer’s confidential information, or materials containing commercial, professional, banking, state or other secrets protected by law;
- do not upload personal data of third parties without lawful grounds (including data of colleagues, interviewers, examiners, teachers, relatives and other persons), or information transferred to the User under a non-disclosure obligation (NDA);
- do not upload unlawful, offensive, extremist, terrorist content, materials containing scenes of sexual exploitation of minors, or other prohibited content.
The User bears full responsibility for the substance of their user content. The Provider does not perform pre-moderation of user content but may remove or restrict access to content that violates these Terms or applicable law.
9. Technical Support
The Provider offers Users customer support regarding the use of the Service, subscription payments, access to features, and technical failures.
Support channel: email admin@offerhack.tech. Response time for inquiries — within 2 (two) business days of receipt. The resolution time depends on the nature of the inquiry.
Support is provided in Russian. Support in other languages may be provided where possible.
10. Suspension and Termination of Access
The Provider has the right, without prior notice, to restrict, suspend or terminate the User’s access to the Service in whole or in part, cancel the subscription, disable individual features, write off or annul improperly obtained credits, remove or restrict user content in the following cases:
- the User’s violation of these Terms, the Public Offer Agreement, the Personal Data Processing Policy, the Refund Policy or applicable law;
- violation of third-party rights, rules of interviews, exams, certifications, proctoring, NDAs, internal policies of employers, educational organizations or other third parties;
- the discovery of false information provided during registration;
- transfer of the account to third parties, sale, lease, shared use, use of the Service by a person other than the User;
- creation of multiple accounts to circumvent limits, obtain repeated trial periods, promotional offers, credits or other restrictions;
- use of automated tools, scripts, bots, parsers, emulators, circumvention of rate limits or other improper use of the Service;
- payment fraud, disputed payment, chargeback, use of someone else’s payment instrument, suspicion of unauthorized payment or other payment violations;
- abnormally high load, mass consumption of resources, attempts to circumvent pricing or technical limits, abuse of functionality;
- occurrence of suspicious activity, threat to the security of the Service, the Provider’s infrastructure, other users or third parties;
- receipt of demands from a court, government authorities, payment providers, rights holders, AI providers, hosting providers or other Third-Party Services;
- non-payment of the subscription — suspension of access to paid features while retaining the account.
The Provider has the right not to disclose to the User the technical details of anti-fraud checks, risk-scores, anti-abuse signals, internal security rules, logs and algorithms for detecting violations, if such disclosure may create a threat to the security of the Service, facilitate circumvention of restrictions or infringe third-party rights.
The procedure for terminating the Public Offer Agreement and refunding the unused portion of payment is governed by Section 14 of the Public Offer Agreement and the Refund Policy.
11. Governing Law and Jurisdiction
These Terms and the relations connected with the Service are governed by the law of the Russian Federation.
Before going to court, the Parties shall make reasonable efforts to resolve disputes through a pre-litigation claim procedure. The time for responding to a claim is 30 (thirty) calendar days from the date of its receipt.
Jurisdiction over disputes with consumers. Where the User uses the Service for personal, family, household, or other needs not connected with business activity (i.e., is a consumer), they have the right to bring a claim in a court of their choice in accordance with Article 17 of the Law of the Russian Federation “On Protection of Consumer Rights”:
- at the location of the Provider;
- at their place of residence or stay;
- at the place where the Agreement was concluded or performed.
This right is mandatory and may not be limited by these Terms or the Public Offer Agreement.
